These Terms of Use ("Terms") govern the relationship of users ("you", "your", "yours") of the https://gaston.tel website and the Gaston mobile application (the "Service") operated by Gaston S.A.R.L. ("we", "us", "our").
Gaston S.A.R.L. is a company registered at 14 rue du Général Delestraint, 75016 Paris, France (SIREN number: 841700164). Our technical infrastructure is provided by, among others, CloudFlare, Vercel, Google, and Twilio.
By accessing and using the Service, you agree to be bound by these terms and to accept all of their legal implications. These terms apply to all visitors and users of the Service.
When you create an account on the Service, your identifier is a cell phone number ("Identifier"). You may not use a person's cell phone number that has not been made available to you as your Identifier. You are responsible for accessing your account using your Identifier and the verification code we text to you via your Identifier. You must promptly notify us of any breach of security or unauthorized use of your account.
Certain aspects of the Service may incur fees. Unless required by law, all fees paid are non-refundable.
Gaston S.A.R.L. offers subscriptions ("Subscription(s)"). You will be billed on a recurring and periodic basis ("Cycle"). At the end of each Cycle, the Subscription is tacitly renewed unless terminated or cancelled for any of the reasons provided herein. We reserve the right to change the Subscription fee. Any changes will be effective upon review and acceptance by you. If a Subscription fee is not paid upon renewal, or if you do not agree to the fee change, we reserve the right to suspend your access to paid features of the Service.
Subscriptions may be subject to a free trial ("Trial") for a limited time. You may be asked to enter your billing information in order to sign up for the Trial. You will not be billed until the Trial expires. At the conclusion of the Trial, unless you have cancelled your Subscription, your Subscription will be considered active and you will automatically be charged the fees that apply to the selected Subscription.
From the App, Subscriptions and their payment are managed by the software platform on your device, such as the App Store or Play Store. You may terminate your Subscription from the platform.
User may request termination of their account by contacting us at support@gaston.tel . Upon receipt of the request sent by email, the user's data will be deleted. The user is responsible for terminating their subscription with the platform providing the Service and for deactivating the Service. Termination does not entitle the user to a refund of the current cycle. Termination does not incur any penalty.
Violation of these terms will result in the suspension of access to the Service.
The Service allows the user to publish, store, share and make available certain information and other materials ("Content"). The User is solely responsible for the Content it publishes using the Service, including its legality, reliability and appropriateness.
By using the Service, the user authorizes the use, modification, performance and reproduction of the Content on or through the Service. The user retains all rights to the Content submitted, stored and displayed on and through the Service.
By using the Service, the user warrants that they own the Content or are permitted to use it.
The Service and its original content (excluding user-contributed content), features and functionality are the exclusive property of Gaston S.A.R.L. Our trademarks may not be used in connection with any product or service without the prior written consent of Gaston S.A.R.L.
When you use the Service, we allow you to download a copy of the material (information or software) of the Service for your personal use. This is a license. Under this license, you may not:
This license becomes automatically void if you violate any of these restrictions and may be terminated by Gaston S.A.R.L. at any time.
We do not guarantee the accuracy or integrity of any information, including prices, product images, specifications, and services. We reserve the right to change or update information and correct errors, inaccuracies, or omissions at any time without notice.
The Service is provided "as is" and "as available". Gaston S.A.R.L. makes no guarantees of any kind, including but not limited to, the results provided by the Service or the availability of the Service.
Gaston S.A.R.L. does not guarantee that any errors or defects will be corrected or that the results of using the Service will meet your requirements.
We reserve the right to modify or replace these Terms at any time, without notice.
Use of the Service is conditioned on your acceptance of the new terms if they are changed.
